34 TAC §20.235

The Comptroller of Public Accounts adopts the repeal of §20.235, concerning purchase of motor vehicles, without changes to the proposed text as published in the May 15, 2026, issue of the Texas Register (51 TexReg 3358). The rule will not be republished.

The comptroller repeals subsection (a) because it is a restatement of statute that was repealed by Senate Bill 1364, 89th Legislature, 2025, effective September 1, 2025.

The comptroller repeals subsections (b) - (d) because they are out-of-date and simply restatements of statute that can now be found in Government Code, Chapter 2158.

The comptroller repeals subsection (e) because the comptroller intends to include this provision in a new rule that will consolidate all rules regarding purchasing preferences.

The comptroller did not receive any comments regarding adoption of the repeal.

This repeal is adopted under Government Code, §2158.0012, which authorizes the comptroller to adopt rules to efficiently and effectively administer Government Code, Chapter 2158.

This repeal implements Government Code, Chapter 2158.

The agency certifies that legal counsel has reviewed the adoption and found it to be a valid exercise of the agency's legal authority.
